One-time Federal Bureau of Investigation Staff Member Alleges Wrongful Termination Due to LGBTQ+ Flag Presence
An experienced FBI operative has filed a legal case claiming his terminated for exhibiting a rainbow symbol in his office space.
As per David Maltinsky, who worked with the bureau since 2009, his termination in the past months was âimproper and biasedâ.
Legal Action Asserts Free Speech Violations
The lawsuit argues that the agency violated the plaintiffâs First Amendment protections and engaged in disciplinary steps against him due to expressing legally safeguarded communication.
The former specialist is asking for a court order to restore his position at the bureau.
Information of the Legal Filing
The 18-page complaint, submitted in federal court in Washington, D.C., states that the employee was terminated from his training in October over before exhibiting the flag in his workspace.
According to the document, the rainbow symbol was awarded to the employee to honor his efforts to support the bureauâs equality efforts.
âFrom a young age, my goal is serve the nation and ensure its security together with the brilliant and dedicated personnel of the FBI,â stated Maltinsky.
He added, âI displayed that banner â that previously flew in front of the Los Angeles office â not for political reasons, but rather as an emblem of inclusion, unity and equal service.
These ideals that helped build the FBI strong. Today it has become where people like me are targeted. I believe I was fired not due to my person, but due to my being: a homosexual man,â he concluded.
Unexpected Dismissal Before Completion
Recently, Maltinsky gained admission to the federal agent training academy at the FBI facility, up until what he described as âsudden termination shortly before graduationâ.
The filing also claims that at some point after the 2017 inauguration, an colleague reported an issue to Maltinskyâs direct supervisor concerning the display of the LGBTQ+ symbol.
âOut of an abundance of caution, Maltinsky requested that the legal advisor for the local bureau examine whether the display of the Progress Pride flag was allowed,â the document said.
The document continued, The legal officer told the plaintiff that exhibiting of the flag did not violate the agencyâs standards.â
Informing of Firing
However, in early October, Maltinsky was notified of his termination.
In correspondence cited in the complaint, bureau chief the official stated, âI have determined that you exercised bad decision-making with the presence of political signage at your workstation while previously assigned at the Los Angeles Field Office.
Under Article II of the U.S. Constitution, and the laws of the U.S., your position at the bureau is now ended.â
Lawyer Statement
In a release issued this week, his legal representative his counsel remarked, âThis administrationâs wrongful dismissal forms part of an extensive initiative to purge federal agencies of employees with alternative perspectives, or are from minority populations, or those who challenge bias.
âDavidâs fight goes beyond his situation, but also about ensuring the liberties and protections of all public servants.â

The FBI refused to respond about the legal action.

Maltinskyâs lawsuit is subsequent to another one submitted earlier by three former top agency personnel that claimed they were wrongfully terminated.
They alleged that the director said he had been directed by the White House to terminate any official involved in a probe into Trump.
